Several new case results! Check them out

Here at Leyba Defense PLLC we only include case results in our “Recent cases” section that result in an outright dismissal or reduction to a traffic ticket. Unlike some other DUI law firms that brag about getting a DUI reduced to reckless driving or negligent driving 1 we don’t consider those outcomes worth writing about. Are they a great outcome? Of course, but getting a DUI reduced is pretty common to the experienced DUI Attorney that is why don’t write about things that commonly occur.

But the last several months we have received some incredible outcomes due to the hard work and perseverance of DUI Attorney Matthew Leyba. You can check them out at our “Recent cases” section on the left navigation. Most recently the firm was able to get a DUI completely dismissed in Seattle Municipal Court due to proof problems. Long story short we negotiated for months and months regarding this case. Over the life of the case Matthew Leyba spoke with 10 different prosecutors. Finally prior to the motion hearing the prosecutor who was handling the motion calendar agreed to dismiss the DUI charge outright.

The moral of the story is this case would have been easy to just disregard after the first Prosecutor said no and set it for trial. Heck that happens every day in Court where I think defense attorneys are sometimes too quick to set a case for trial. They get frustrated with the lack of negotiation by a Prosecutor and just say to heck with it let’s go to trial. And sometimes that is the only play.

But in my opinion if a DUI Attorney can speak with as many prosecutors as possible during the negotiation that increases the chances of finding that one that will listen to the issues in your case. Sometimes it is fruitless because the first prosecutor will write in the file for later prosecutors not to change their sentence recommendation, but my point is you need to try and try. And when you feel like there is nobody else to negotiate with try again.

Because every now and then it pays off and I would rather have a Prosecutor agree to dismiss a DUI than take a chance on having a Judge dismiss or have a jury found the client not guilty. Those are big risks these days.
